PRESTONSBURG — One man set to have a hearing in Floyd County District Court was allegedly assaulted in the holding cell, as court was in session Tuesday afternoon.

While court was in session for the preliminary hearing of Benjamin Kidd, a loud commotion could be heard coming through the walls, and courtroom bailiffs quickly ran to check the source of the noise. Moments later, one bailiff returned to court and told Judge Johnny Ray Harris that Lawrence Kimmel, who was scheduled to be called later in the court’s docket, had been assaulted in the cell.

Kimmel was charged earlier this month with complicity to a sexual assault which took place in June. Kimmel is accused of standing as lookout while an attack was carried out against a fellow prisoner in one of the holding cells of the Floyd County Detention Center. The two other men charged in connection with the sexual assault in the jail, Richard Mullins and Justin Lee, were not in court on Tuesday.

Though officials would not confirm the identity of those involved, it is believed that Robert Brady, an inmate who had minutes earlier had his own preliminary hearing, was involved. Paramedics were called to treat the injuries Kimmel sustained.

Robert Brady had appeared in court earlier Tuesday afternoon to hear the charges against him. Brady was charged with child abuse after he allegedly threw his 11-month-old child into a chair, before proceeding to get into a fight with his wife.

Kimmel’s preliminary hearing will be rescheduled.
