An unidentified witness accused Charles “Andy” Gill, 31, of Lake, of growing marijuana out of his father’s house in the area of Lake LaVilla on Craddock Fork and said he had at least one pistol in his possession.

When officers got to the residence, there was a strong odor of marijuana. Andy Gill answered the door and advised his father was the owner of the residence and was in a garage on the back of the property. Gill also advised the officers he had one or two plants and he doesn’t bother anybody.

Gill’s father spoke with the officers and told them he believed his son just had three or four plants growing in his bedroom and signed a Consent to Search Form and recorded his permission for the officers to search the residence.

The officers found an extensive indoor marijuana grow in Gill’s bedroom. A large grow tent with lights, fans and an exhaust setup held 26 plants. Ten more plants were discovered in the small bedroom closet.

In addition to the plants, a large amount of cultivation supplies, chemicals, soil and seeds were located in the bedroom, along with a large amount of small plastic baggies with a marijuana plant logo stamped on them. A small digital camera had numerous photos of marijuana plants growing in the accused’s bedroom.

A loaded 9mm Sig Sauer pistol was found under the mattress on Gill’s bed. Based on his having two prior felony convictions, Gill is prohibited from the possession of firearms. A large box of 9mm ammunition was under Gill’s bed.

Officers found another large grow tent in the garage, but no plants were growing there. A homemade plywood box with lights and reflective material was also found in the garage.

Gill was arrested and charged with cultivation of marijuana, possession with intent to deliver and a prohibited person in possession of a firearm.

His bond was set at $25,000.
