West Virginia State Police officers on patrol were nearly involved in an accident after a car crossed the center line on WV Route 10.

A criminal complaint filed in the magistrate court of Logan County said officers stopped the vehicle and identified the driver as Larry Skaggs, 38, of Logan.

The officers note a strong odor of an alcoholic beverage on Skaggs’ breath, observed his eyes were glassy and bloodshot and he was sweating and shaking uncontrollably.

When officers asked Skaggs to step out so they could administer standardized field sobriety tests, he failed the Horizontal Gaze Nystagmus (HGN), One Legged Stand (OLS), Walk and Turn (WAT). He refused to take the Preliminary Breath Test (PBT).

Skaggs was transported to Logan Regional Medical Center for a blood test (results pending), and then to the WVSP detachment for processing, where he failed to give a sufficent intoximeter sample during three tries, then refused further testing.

Officers reviewed Skaggs’ criminal history and found he had two prior DUI’s effective July 15, 2010, and August 25, 2010, he had two prior driving revoked DUI’s from April 20, 2013 and December 13, 2011, and he was out on two bonds (one for driving revoked DUI).

Skaggs was charged with DUI 3rd offense, driving revoked for DUI 3rd offense and left of center.
