A West Virginia State Police on patrol initiated a traffic stop on a vehicle in the Mitchell Heights area of Logan County.

The vehicle’s driver was identified as Gary Lee Jeffrey, Jr., 28, of Pecks Mill.

The criminal complaint filed in the magistrate court of Logan County says Jeffrey was not wearing a seat belt and the officer detected the smell of alcohol coming from the vehicle and Jeffrey had very slurred speech.

It further states Jeffrey had trouble keeping his balance upon exiting the vehicle and advised the officer he had been drinking and he had two beers.

The officer administered three field sobriety tests, which Jeffrey failed. A preliminary breath test was administered, with a result of .227.

Jeffrey was unable to provide a driver’s license.

Results of a Department of Motor Vehicle inquiry indicated Jeffery’s driver’s license was revoked for a DUI with a conviction on January 4, 2010, and two pending driving revoked for DUI, one on September 15, 2012, and the other on March 20, 2009.

The officer transported Jeffrey to the W.Va. State Police Detachment where he administered a secondary chemical test which indicated Jeffrey’s blood alcohol content was .170.

Jeffrey was charged with DUI, driving suspended, unsafe/improper equipment and no seat belt. His bond was set at $7,500.
